11. The Guidelines stipulate that the Originator should not have control over the assets transferred to the SPV. Can the Originator be a servicer and still comply with this requirement?

The Originator may act as a servicer in a securitisation transaction if the services are provided on an arm?s length basis and at market terms as provided for in paragraph 6.5 of the ABS Guidelines.
 

 

Remark: A Bond is a debt investment in which an investor loans money to an entity (corporate or governmental) that borrows the funds for a defined period of time at a fixed interest rate.
